The objective of the present text is to develop a reflection about the value of human life in today’s society bringing into focus the contrasting perspectives of the ordinary and the extraordinary of life. For that purpose, we emphasize the conception of the Catholic Church from the Second Vatican Council that suggests an attitude of a Pilgrim Church which longs for dialogue with human beings in their ordinary life (we intend to rescue the positive sense of the term "ordinary"), in (...) disadvantage of the triumphalist vision which gives priority to the great deeds of history. In that sense, we establish a dialogue with the literal work Crime and Punishment (1866) by Fyodor Dostoyevsky whose protagonist Raskolnikov reveals himself through the contemporary dilemma between being and not being extraordinary in the eyes of the society. His moral conscience is tested after a crime he committed. The apex of this revelation takes place after the reading of the Gospel relating to the resurrection of Lazarus shared with Sonia, a flagrant sinner, an ordinary in the eyes of the society represented in the work. In fact, how it happens in the painful passage of Raskolnikov, God makes himself known through the other in borderline situations and we take him into account through the experience which a man of faith realizes when discovering Him to be present. The presence of God in the world is surely not to be understood in the sphere of the extraordinary, what matters is the experience of refuge when we are seduced by the faith. (shrink)

O presente trabalho tece considerações sobre o problema metodológico que o pensamento político de Arendt confronta. Procuramos destacar que, embora seja errôneo atribuir a Arendt a posse de um método, no sentido tradicional do termo, podemos falar de um exercício de pensamento expresso no verbo “compreender” e no seu correlato “pensar o que estamos fazendo”. Iremos explorar a riqueza semântica que o compreender adquire nas reflexões da autora, apresentando o termo primeiramente como exercício de pensamento e, em seguida, como metáfora (...) filosófica do espectador, procurando distinguir a compreensão do filósofo-espectador da compreensão do homem de ação, traçando os limites entre o filósofo e o político. Veremos que a recusa de Arendt a refletir sobre um método relaciona-se com a recusa a fazer de si um critério normativo para o pensamento alheio. Se Arendt ressalta a importância de pensar o que estamos fazendo, não fornece respostas prontas para este dilema, mas reserva ao interlocutor a tarefa de pensar por si mesmo e chegar a suas conclusões particulares. Although Leibniz characterised himself in the “New Essays” as a “Platonic” as opposed to a “Democritean” philosopher, his intellectual relationship with the most famous of the Renaissance Neoplatonists, Marsilio Ficino, has received little attention. Here we review what can be thus far established regarding Leibniz’s acquaintance with portions of Ficino’s Opera omnia of 1576. We compare Ficino’s disenchantment with the atomistic materialism of Lucretius, which he had favoured in his youth, and his turn to Platonism for inspiration, with Leibniz’s own (...) reported disenchantment with Gassendi’s Epicurean atomism and his invention of a vitalistic monadology that, despite Leibniz’s reservations regarding Ficinian magic, resembles Ficinian nature philosophy in number of striking respects. An intuitive view is that creativity involves bringing together what is already known and familiar in a way that produces something new. In cognitive science, this intuition is typically formalized in terms of computational processes that combine or associate internally represented information. From this computationalist perspective, it is hard to imagine how non-representational approaches in embodied cognitive science could shed light on creativity, especially when it comes to abstract conceptual reasoning of the kind scientists so often engage in. The present (...) article offers an entry point to addressing this challenge. The scientific project of embodied cognitive science is a continuation of work in the functionalist tradition in psychology developed over a century ago by William James and John Dewey, among others. The focus here is on how functionalist views on the nature of mind, thought, and experience offer an alternative starting point for cognitive science in general, and for the cognitive science of scientific creativity in particular. The result may seem paradoxical. On the one hand, the article claims that the functionalist conceptual framework motivates rejecting mainstream cognitive views of creativity as the combination or association of ideas. On the other hand, however, the strategy adopted here—namely, revisiting ideas from functionalist psychology to inform current scientific theorizing—can itself be described as a process of arriving at new, creative ideas from combinations of old ones. As is shown here, a proper understanding of cognition in light of the functionalist tradition resolves the seeming tension between these two claims. (shrink)

L’examen du corpus constitué par les régimes de santé en Europe, entre la fin du xvie siècle et le xviiie siècle, permet d’apporter des réponses intéressantes à la question de savoir si l’on peut vieillir sans médecins. Depuis le Trattato de vita sobria de l’Italien Luigi Cornaro (1558) jusqu’à The History of Health and the Art of Preserving it (1758) rédigée par l’Écossais James MacKenzie, on assiste à un effort pour distinguer le processus naturel du vieillissement de la vieillesse (...) comme maladie. L’approche médicale préventive et diététique du vieillissement se trouve ainsi intégrée au sein d’une réflexion anthropologique et le projet de prolongation de la vie justifiée d’un point de vue théologique. L’enjeu est bien de s’efforcer de penser le sens moral, politique et plus généralement existentiel d’une vie humaine prolongée. (shrink)

O artigo que se segue formula reflexões acerca de um evento cujo distanciamento e imparcialidade são impossíveis. O caráter ensaístico da escrita é, neste sentido, exigência do próprio evento em análise. Não escrevemos para fornecer respostas, nem com o distanciamento de Heródoto, que evocou de igual forma testemunhos históricos feitos de gregos e troianos; escrevemos para compreender, enfrentar e resistir ao problema. Dessa forma, o presente artigo aborda a pandemia do coronavírus de maneira que possibilite contribuir para uma melhor compreensão (...) do fenômeno que estamos experienciando. Para isso, de início, analisa-se a atual pandemia em suas relações com a modernidade e seu caráter globalizante. Em seguida, adentrando em uma perspectiva que transita entre fatores econômicos e políticos, o artigo destaca as consequências das políticas neoliberais que tornaram o cenário pandêmico uma crise dentro da crise. Para além de uma crise econômica, configura-se como uma crise humanitária. Para tanto, desembocando no dilema que o neoliberalismo impõe à humanidade, o lucro ou as pessoas, expõem-se nitidamente as fissuras do capitalismo. Por fim, analisa-se a atuação da necropolítica na pandemia e discutem-se as medidas de isolamento social a partir de conceitos como "Estado de exceção", e "vigilância". (shrink)

In three articles published in Blackwood's Magazine , one Wilson, under the nom de guerre of Christopher North, propounded the view that Shakespeare's Othello operates on a double time scheme. The represented time in Cyprus is some thirty-three hours, lasting from about 4 p.m. on Saturday till the early hours of Monday morning. If we take this time scheme at face value, there has been no opportunity for Desdemona and Cassio to commit adultery: Iago's insinuations and Othello's suspicions are (...) manifestly absurd. However, another time scheme is in operation as well. By its clock, the protagonists have been in Cyprus for more than a week. For example, we find Bianca, a local courtesan, complaining that it has been ‘seven days and nights, / Eight score eight hours’ since she last saw Cassio, who by the first time scheme had arrived in Cyprus only the day before. Resumo: Pretende-se neste artigo analisar a noção nietzschiana de filósofo do futuro e sua contribuição para o surgimento do novo homem, tendo em vista, prioritariamente, Além de bem e mal. Para tanto, iniciaremos analisando de que forma esta obra pode ser considerada, segundo a pretensão de seu autor, como uma crítica da modernidade e, consequentemente, de que forma ela se constitui como o manifesto de uma tarefa que Nietzsche define como própria dos filósofos do futuro: a superação do passado, ou (...) seja, das formas metafísicas, dogmáticas e ascéticas que orientaram a filosofia ao longo da história, por meio dos “trabalhadores filosóficos”, que agora devem ceder lugar aos autênticos filósofos, cujas lentes fisiopsicológicas examinam o pensamento como sintoma da saúde ou da doença de seus autores. Com isso, Nietzsche substitui a antiga tarefa do filósofo por uma nova missão. Com essa reflexão, acredita-se margear alguns dos problemas centrais da pesquisa do homenageado desse dossiê, prof. Wilson Antonio Frezzatti Jr.: This paper intends to analyze the Nietzschean notion of philosopher of the future and its contribution to the emergence of the new man, having in mind, primarily, Beyond good and evil. In order to do so, we will begin by analyzing how this work can be considered, according to the author’s intention, as a critique of modernity and, consequently, in what way it constitutes the manifesto of a task that Nietzsche defines as proper to the philosophers of the future: the overcoming of the past, that is, of the metaphysical, dogmatic and ascetic forms that have guided philosophy throughout history, through the “philosophical workers”, who must now give way to authentic philosophers, whose physiopsychological lenses examine thought as symptom of the health or illness of its authors. With this, Nietzsche replaces the philosopher’s old task with a new mission. With this reflection, it is believed that some of the central problems of the research of the honoree of this dossier, prof. Wilson Antonio Frezzatti Jr., are bordered. (shrink)

Though P. G. Tait was in a seemingly perfect position to teach both William Thomson's thermodynamics and James Clerk Maxwell's electromagnetic theory of light, he did not. Tait probably first encountered the new thermodynamics in the 1850s at Queen's College, Belfast, and presented the ideas in his inaugural lecture at Edinburgh in 1860, soon making energy theory the centre-piece of his course there. The comprehensiveness of energy theory plus Thomson's opposition to Maxwell's electromagnetic theory evidently combined in causing Tait (...) to de-emphasize Maxwell's theory. Ironically, Tait, the loyal Scot, thus inadvertently contributed to what might be termed the Anglicization of Scottish natural philosophy. (shrink)

Following Jacques Hadamard, applied mathematicians typically investigate their models in the form of well-set problems, which actually consist of a family of applicational circumstances that vary in specific ways with respect to their initial and boundary values. The chief motive for investigating models in this wider manner is to avoid the improper behavioral conclusions one might reach from the consideration of a more restricted range of cases. Suitable specifications of the required initial and boundary variability typically appeal to previously established (...) experimental conclusions as to how the target system will behave under a range of eternally applied manipulations of the form “If the conditions pertaining to S were altered in manner M, internal features X would/would not alter”. In his investigations of causal reasoning within other parts of science, our first author has emphasized the conceptual importance of counterfactuals of this nature, for which he was been often criticized by authors of a self-styled “metaphysical” inclination. The purpose of this note is to argue, pace these objections, that closely analogous considerations have long been part of the practice of investigating differential equation models in a sensible way. Just health: meeting health needs fairly is an ambitious book, in which Norman Daniels attempts to bring together in a single framework all his work on health and justice from the past 25 years. One major aim is to reconcile his earlier work on the special moral importance of healthcare with his later work on the social determinants of health. In his earlier work, Daniels argued that healthcare is of special moral importance because it protects opportunity. In this later work, (...) Daniels argues that the social determinants of health (which in fact tend to have a larger effect on health outcomes than healthcare does) should also be considered special. This paper argues that it is a mistake to base a theory of justice for health on the claim that health (or the social determinants of health) are "special", for three reasons. First, once we realise that health is to a large part socially determined by features such as distribution of income, which are also of independent importance for justice, we cannot talk about a theory of justice for health in isolation from an overall theory of justice. Second, when we are trying to work out the place of health in a general theory of justice, being told that health (or the social determinants of health) is special is unhelpful. The relevant starting point should rather be whether health matters in a fundamental way for justice, or whether it matters merely for the effects it has on those goods which are of fundamental importance for justice. Third, treating the social determinants of health as special would in fact be counterproductive in terms of the broad approach to justice Daniels favours. (shrink)

De modo nunca antes visto, crises de diferentes matrizes tem eclodido nos quatro cantos da Terra, se estabelecendo no mais das vezes como estados permanentes a experiência social humana. Das tragédias decorrentes dos efeitos do aquecimento global a pandemia de Covid-19, a humanidade tem convivido com um fenômeno comum do norte ao sul da aldeia global, a ascensão de forças políticas alinhavadas a espectros ideológicos de extrema direita. Este fenômeno tem sido atribuído, sobretudo, ao fluxo massivo de desinformação como estratégia (...) de comunicação com as massas viabilizadas por meio das ditas “redes sociais”, aquecidas pelo lucrativo modelo de negócios das plataformas. Com pouco dissenso, pesquisadores têm concluído que essa relação tem provocado uma aparente desordem informacional, que por sua vez sintetizaria diversos aspectos próprios dessa dita “nova era”, tais como: pós-verdade, fake news, redes de ódio e negacionismo. Na contramão deste entendimento, amparados na teoria da informação da 2ª geração cibernética e na perspectiva dialética dos processos infocomunicacionais buscamos problematizar como esta nova ordem social produzida pela desinformação tem reajustado novos sentidos sobre o mundo provocando uma crise na ordem das referências sociais. Valendo-nos da relação entre os conceitos de sistema, ambiente e contexto, na produção de sentidos sobre o mundo, concluímos que a desinformação não tem se constituído como propriedade de desordem informacional, mas como princípio regulador de uma nova ordem sedimentada em mentiras, alucinações, propaganda, intolerância e barbárie, elementos que põe em xeque os princípios que orientam a ordem civilizatória e o ideário de democracia que norteia a Modernidade. O fenômeno da desinformação tem tomado centralidade no debate público nos últimos tempos. As discussões e ações de combate a conteúdos desinformativos têm sido impulsionadas pelos mais diversos setores da sociedade, motivadas, sobretudo, pela massificação da produção, circulação e consumo de fake news. Entretanto, a desinformação não se restringe apenas ao ambiente da circulação de notícias falsas por pseudo mídias jornalísticas, nem tampouco se caracteriza como um fenômeno novo. É possível remontar outros contextos históricos onde o viés desinformativo tem sido (...) utilizado como política de Estado, estratégia de guerra e produção de consenso em torno de verdades anunciadas. Nesse sentido, o que torna a desinformação um problema tão urgente e atual? Buscando responder essa questão nossa proposta parte de uma discussão teórico-analítica ancorada em uma perspectiva marxiana de economia política. Para tanto, iremos operar com duas noções que consideramos essenciais para elucidar essa questão, sendo elas: a lógica do Capital Informação e a noção de valor no ambiente de uma economia política das plataformas sócio-digitais. A relação informação e capital tem sido vital para a produção do habitus informacional no século XXI, seja pelo cada vez maior trânsito de usuários interconectados à grande rede, seja pela massificação da produção de artefatos infocomunicacionais que possibilitam a manutenção desse fluxo. Sob o ponto de vista econômico, a informação é a matéria que passa a estruturar a lógica de organização do capital, e, por conseguinte, também a ordem social, política e cultural das sociedades contemporâneas. Desse modo, é na (...) atual vigência do capital, entendido aqui como capital-informação, que vimos emergir o modelo de negócios da economia das plataformas sócio-digitais amparado na cultura algorítmica, no paradigma comunicacional todos-todos e na mineração constante de dados de usuários. Esse modelo altamente lucrativo tem sido apontado como um dos principais responsáveis pela disseminação massiva de conteúdo desinformativo através do fenômeno das fake news, regime de pós-verdade, propensão a formação de filtros-bolha, câmaras de eco, cultura do cancelamento e disseminação de ódio nas infovias. Com isso, neste trabalho buscamos problematizar a noção de informação tóxica como reflexo de um ambiente informacional pautado pela toxicidade, virulência, sectarismo, polarização e predisponência a violência digital como dispositivos que tem perfilado o comportamento dos indivíduos nas redes e fora delas, evocando velhos estigmas, preconceitos, perseguições e falsas crenças direcionadas a grupos e indivíduos considerados material e simbolicamente como ameaças. Conclui-se assim, que a informação tóxica é um desafio a ordem democrática e civilizatória, constituindo-se como um sintoma de uma sociedade adoecida, bem como uma mercadoria de altos rendimentos na sociedade do capital-informação. Este trabalho tem por objetivo refletir sobre a relação entre a tese da mente estendida e do papel do corpo no uso das estratégias de aprendizagem. Nas discussões, tecemos algumas possíveis interseções entre a teoria das estratégias de aprendizagem com a tese da mente estendida de Andy Clark e David Chalmers e o papel do corpo. Em um primeiro momento, apresentamos a teoria das estratégias de aprendizagem. Em seguida, fizemos uma breve exposição da teoria da mente estendida. De modo subsequente, (...) refletimos sobre as possíveis aproximações entre o conceito de estratégias de aprendizagem e a tese da mente estendida e refletimos sobre o papel do corpo no uso de estratégias de aprendizagem. Por último, apresentamos as considerações finais como um esboço de possíveis contribuições da interseção entre as teorias e deixamos apontamentos para estudos futuros. (shrink)

Democracy establishes relationships of political equality, ones in which citizens equally share authority over what they do together and respect one another as equals. But in today's divided public square, democracy is challenged by political thinkers who disagree about how democratic institutions should be organized, and by antidemocratic politicians who exploit uncertainties about what democracy requires and why it matters. Democratic Equality mounts a bold and persuasive defense of democracy as a way of making collective decisions, showing how equality of (...) authority is essential to relating equally as citizens. James Lindley Wilson explains why the US Senate and Electoral College are urgently in need of reform, why proportional representation is not a universal requirement of democracy, how to identify racial vote dilution and gerrymandering in electoral districting, how to respond to threats to democracy posed by wealth inequality, and how judicial review could be more compatible with the democratic ideal. What emerges is an emphatic call to action to reinvigorate our ailing democracies, and a road map for widespread institutional reform. Democratic Equality highlights the importance of diverse forms of authority in democratic deliberation and electoral and representative processes—and demonstrates how that authority rests equally with each citizen in a democracy. Chronic migraine is a difficult disease to diagnose, and its pathophysiology remains undefined. Its symptoms affect the quality of life and daily living tasks of the affected person, leading to momentary disability. This is a pilot, randomized, controlled, double-blind clinical trial study with female patients between 18 and 65 years old with chronic migraine. The patients underwent twelve mindfulness sessions paired with anodal transcranial direct-current stimulation over the left dorsolateral prefrontal cortex, with current intensity of 2 mA applied for 20 (...) min, three times a week for 4 weeks. In addition, 20 min of mindfulness home practices were performed by guided meditation audio files. A total of 30 participants were evaluated after the treatment, and these were subdivided into two groups—active tDCS and sham tDCS, both set to mindfulness practice. The FFMQ-BR, MIDAS, and HIT-6 questionnaires were used to evaluate the outcomes. After the treatment, the active mindfulness and tDCS group showed better results in all outcomes. The sham group also showed improvements, but with smaller effect sizes compared to the active group. The only significant difference in the intergroup analysis was the outcome evaluated by HIT-6 in the post treatment result. Our results provide the first therapeutic evidence of mindfulness practices associated with left DLPFC anodal tDCS with a consequent increase in the level of full attention and analgesic benefits in the clinical symptoms of patients with chronic migraine. This work argues that philosophy is not just useful, but vital, for thinking coherently about priorities in health policy and public policy.

Abstract This paper aims to shed some light on the difficulties we face in constructing a generally acceptable normative framework for thinking about public health. It argues that there are three (...) factors that combine to make theorising about public health difficult, and which when taken together defeat simplistic top-down and bottom-up approaches to the design of public health policies. The first factor is the problem of complex systems, namely that the distribution of health both affects and is affected by the distribution of other goods. The second is the difficulty of defining the goals of public health: we still need to get clear about what we should mean by health in this context, and what the goals of public health should be. The third is that we stand in need of an account of how important health is relative to the importance of other goods that a just society should be trying to secure for its citizens. The paper argues that these problems should lead us to abandon the search for a ‘one-size fits all’ normative framework for thinking about public health. The pandemic significantly raised the stakes for the translation of bioethics insights into policy. The novelty, range and sheer quantity of the ethical problems that needed to be addressed urgently within public policy were unprecedented and required high‐bandwidth two‐way transfer of insights between academic bioethics and policy. Countries such as the United Kingdom, which do not have a National Ethics Committee, faced particular challenges in how to facilitate this. This paper takes as a case study the brief career of the (...) Ethics Advisory Board (EAB) for the NHS Covid‐19 App, which shows both the difficulty and the political complexity of policy‐relevant bioethics in a pandemic and how this was exacerbated by the transience and informality of the structures through which ethics advice was delivered. It analyses how and why, after EAB's demise, the Westminster government increasingly sought to either take its ethics advice in private or to evade ethical scrutiny of its policies altogether. In reflecting on EAB, and these later ethics advice contexts, the article provides a novel framework for analysing ethics advice within democracies, defining four idealised stances: the pure ethicist, the advocate, the ethics arbiter and the critical friend. The infant mortality rate in Liberia is 50 times higher than it is in Sweden, whilst a child born in Japan has a life expectancy at birth of more than double that of one born in Zambia. 1 And within countries, we see differences which are nearly as great. For example, if you were in the USA and travelled the short journey from the poorer parts of Washington to Montgomery County Maryland, you would find that ‘for each mile travelled life (...) expectancy rises about a year and a half. There is a twenty-year gap between poor blacks at one end of the journey and rich whites at the other’. (Marmot, 2004, p.2). There are two types of questions which it is important to ask about inequalities in health such as these. The first are social scientific questions about the extent of inequalities in health and the factors which are causally responsible for these inequalities. Examples of social scientific questions to ask might be: how do infant mortality rates in the UK differ according to social class? What is the difference in life expectancy between Japanese who emigrate to the US and those who remain in Japan? Why do civil servants in higher ranked jobs tend to live longer than civil servants in lower ranked jobs? The second type are normative questions about the reasons we have to care about inequalities in health. Important normative questions to answer are: which inequalities in health should we care about (all inequalities or merely some of them)? When is an inequality in health unjust? How should we weigh our concern for equality in health against other factors such as maximising the.. (shrink)

Research involving human subjects is much more stringently regulated than many other nonresearch activities that appear to be at least as risky. A number of prominent figures now argue that research is overregulated. We argue that the reasons typically offered to justify the present system of research regulation fail to show that research should be subject to more stringent regulation than other equally risky activities. However, there are three often overlooked reasons for thinking that research should be treated as a (...) special case. First, research typically involves the imposition of risk on people who do not benefit from this risk imposition. Second, research depends on public trust. Third, the complexity of the moral decision making required favors ethics committees as a regulative solution for research. (shrink)

Three main claims are made in this paper. First, it is argued that Onora O’Neill has uncovered a serious problem in the way medical ethicists have thought about both respect for autonomy and informed consent. Medical ethicists have tended to think that autonomous choices are intrinsically worthy of respect, and that informed consent procedures are the best way to respect the autonomous choices of individuals. However, O’Neill convincingly argues that we should abandon both these thoughts. Second, it is argued that (...) O’Neill’s proposed solution to this problem is inadequate. O’Neill’s approach requires that a more modest view of the purpose of informed consent procedures be adopted. In her view, the purpose of informed consent procedures is simply to avoid deception and coercion, and the ethical justification for informed consent derives from a different ethical principle, which she calls principled autonomy. It is argued that contrary to what O’Neill claims, the wrongness of coercion cannot be derived from principled autonomy, and so its credentials as a justification for informed consent procedures is weak. Third, it is argued that we do better to rethink autonomy and informed consent in terms of respecting persons as ends in themselves, and a characteristically liberal commitment to allowing individuals to make certain categories of decisions for themselves. Respect for autonomy is in trouble. In recent work in this journal1 and elsewhere,2 O’Neill has forcefully argued that respect for autonomy, as it has come to be used in medical ethics, is philosophically indefensible. If her arguments are sound, then, contrary to the standard view, respect for autonomy cannot be the source of the ethical requirement to seek informed consent before treating a patient or enrolling a participant in a trial. So her critique goes to the heart of contemporary medical ethics: if O’Neill is right, medical ethicists have systematically misunderstood two of the most fundamental concepts they deal with—respect for autonomy and informed consent. This paper has four sections. Section 1 distinguishes between three different ways of talking about respect for autonomy, and looks in more detail at the one that has come to be central to bioethical writing on informed consent—namely, the idea that we should respect autonomous choices. Section 2 argues, following O’Neill, that it is implausible to think that the purpose of informed consent requirements is to respect autonomous choices. Section 3 argues that O’Neill’s proposed reworking of autonomy and informed consent is inadequate. O’Neill’s approach requires us to adopt a more modest view of the purpose of informed consent procedures. In her view, the purpose of informed consent procedures is simply to avoid deception and coercion, and the ethical justification for informed consent derives from a different ethical principle, which she calls principled autonomy. I argue that contrary to what O’Neill claims, we cannot derive the wrongness of coercion from principled autonomy, and so its credentials as a justification for informed consent procedures is weak. Section 4 argues that we do better to rethink autonomy and informed consent in terms of respecting persons as ends in themselves, and a characteristically liberal commitment to allowing individuals to make certain categories of decisions for themselves. O magistrado justo equidistante manifesta-se no âmbito interno do processo livre dos interesses conflituosos sobretudo no freio estatal do jus puniendi. Logo, a função jurisdicional do juiz caracteriza-se pela imparcialidade nos processos, referenciando-se, por exemplo, no conceito de justiça corretiva e de equidade de Aristóteles. Neste diapasão jurídico, o artigo discorre sobre a sistemática filosófica da justiça em Aristóteles, recepcionando o conceito do juiz das garantias inserido na lei 13.964/2019, e sua aplicabilidade.

O presente artigo apresenta o estado da questão sobre a tríade Filosofia da Ciência, Currículo e Formação de Professores, sendo parte de uma pesquisa em andamento realizada no Programa de pós-graduação-Mestrado em Educação que tem como objetivo compreender a importância da Filosofia da Ciência no currículo dos cursos de licenciatura na área de Ciências Naturais. A construção do estado da questão possibilita o mapeamento das pesquisas referentes ao nosso objeto de estudo, bem como desvela o conhecimento sobre como se encontra (...) o tema investigado no contexto atual das produções científicas. Foi realizado um levantamento de artigos nos periódicos com conceitos qualis de A1 a B2 no Portal da Capes, nas produções presentes no Banco Digital de Teses e Dissertações e nos trabalhos publicados na Associação Brasileira de Pesquisa em Educação em Ciências, no intuito de identificar artigos, teses e dissertações referente a nossa temática. Os dados coletados foram organizados e analisados considerando os objetivos, o referencial teórico e a metodologia dos trabalhos encontrados. Os resultados demonstraram que a grande maioria dos trabalhos pertencem a região sul e sudeste, e que ainda são raras as pesquisas nesta área de estudo, principalmente no nordeste. Demonstraram também que às pesquisas tem como sujeitos professores, mas não professores-formadores e que as mesmas utilizam metodologias semelhantes com os mesmos instrumentos de coleta de dados, revelando-nos que o caminho escolhido para a realização do nosso estudo encontra-se afinado com aquilo que se tem pesquisado na área, mas também demonstrou o quanto esta pesquisa pode contribuir, pois lança um novo olhar sobre a temática, quando pensa sobre o professor formador e inova com o uso de uma metodologia ainda não utilizada nos trabalhos encontrados referentes a essa temática. Com isso o desenvolvimento da nossa pesquisa irá somar a produção de conhecimentos na área da filosofia da ciência articulada a formação docente, que ainda é pouco estudada, considerando o seu tempo de existência. In preparing for a lecture on the ethics of surgical complications, it became apparent that confusion exists about the definition of a ‘‘surgical complication.’’ Is it, as one medical website states, ‘‘any undesirable result of surgery?’’ [1]. In the European Journal of Surgery, Veen et al. [2] provide a more elaborate definition: ‘‘every unwanted development in the illness of the patient or in the treatment of the patient’s illness that occurs in the clinic’’ [2]. An esteemed historian of science suggests (...) yet another definition in a recent volume on surgical complications: ‘‘a complication, in any sphere of endeavour, is something out of the norm, and the product of extraneous and unexpected factors’’ [3]. Such is the discrepancy in definitions that Rampersaud et al. [4] declared in 2006 that ‘‘presently, there is no clear or consistent definition of a complication in the surgical literature.’’ Much research in surgery aims to reduce the risk of surgical complications. However, until we have a stable and agreed definition of what counts as a surgical complication, we cannot reliably compare different studies to discover what best reduces the chance of surgical complications [5]. Therefore, the topic is more than mere pedantry; defining surgical complications will help us with the broader question of how to improve surgical practice. A basic PubMed search returned nearly 800 articles with the phrases ‘‘surgical complications’’ or ‘‘surgical complication’’ in the title. But unlike the sources above. (shrink)

Intellectual property typically involves claims of ownership of types, rather than particulars. In this article I argue that this difference in ontology makes an important moral difference. In particular I argue that there cannot be an intrinsic moral right to own intellectual property. I begin by establishing a necessary condition for the justification of intrinsic moral rights claims, which I call the Rights Justification Principle. Briefly, this holds that if we want to claim that there is an intrinsic moral right (...) to φ, we must be able to show that (a) violating this right would typically result in either a wrongful harm or other significant wrong to the holder of the right, and (b) the wrongful harm or other wrong in question is independent of the existence of the intrinsic right we are trying to justify. I then argue that merely creating a new instance of a type is not the kind of action which can wrongfully harm the creator of that type. Insofar as there do seem to be wrongs involved in copying a published poem or computer program, these wrongs presuppose the existence of an intrinsic right to own intellectual property, and so cannot be used to justify it. I conclude that there cannot be an intrinsic right to own intellectual property. (shrink)

In this essay, I make the interpretive claim that we cannot properly understand the Federalist without appreciating the extent to which the papers mount a sustained rejection of extra-constitutional democracy—practices in which people aim to assert authority over the terms of common life in ways that are not sanctioned by existing laws. I survey such practices, which were common in America before and after the Revolution. I argue that there is continuity between Publius’s justification for rejecting extra-constitutional democracy and his (...) justification for his preferred system against constitutional alternatives. Adequate analysis and evaluation of the Federalist’s arguments about faction, representation, and institutional design require attention to the double duty the arguments play against constitutional and extra-constitutional opposition. This interpretive argument supports several analytic and evaluative conclusions. First, we must distinguish a new form of “non-hierarchical dualist” constitutionalism, according to which irregular democratic activity need not be limited to extraordinary “constitutional moments” or revolutions. Second, the politically egalitarian character of procedures depends not on the procedures alone, but how the maintenance of such procedures limits other forms of democratic practice. Third, the argument suggests a novel defense of “uncivil” disobedient politics: one grounded not in contributions to democratic deliberation, but in the entitlements of citizens to direct assertions of authority over common life. This article introduces a symposium on Daniel Hausman’s Valuing Health: Well-Being, Suffering and Freedom. The symposium contains papers by Elselijn Kingma, Adam Oliver, Anna Alexandrova, Erik Nord, Alex Voorhoeve and James Wilson, with replies by Daniel Hausman. In Valuing Health, Hausman argues that, despite apparently measuring health, projects such as the Global Burden of Disease Study in fact measure judgments about the value of health. Once this has been clarified, the key question is how the value of health (...) should be measured. Hausman argues that existing instruments measure the private value of health, that is, health’s ‘contribution to whatever the individual cares about or should care about’, whereas what should be measured for resource allocation purposes is the public value of health, that is, the value health should be accorded from the perspective of the liberal state. Hausman argues that the public value of health should be measured by the extent to which suffering and activity limitations are relieved. “This chapter looks at four arguments which Microsoft has used to justify the claim that illegal copying of software is wrong: software piracy is theft; software piracy violates the rights of copyright holders; software piracy is free riding; and software piracy reduces incentives to future innovation. It argues that the first argument is simply wrong, and the other three do not establish that it is in fact wrong to pirate Microsoft’s programs.

Fair allocation of scarce healthcare resources has been much studied within philosophy and bioethics, but analysis has focused on a narrow range of cases. The Covid-19 pandemic provided significant new challenges, making powerfully visible the extent to which health systems can be fragile, and how scarcities within crucial elements of interlinked care pathways can lead to cascading failures. Health system resilience, while previously a key topic in global health, can now be seen to be a vital concern in high-income countries (...) too. Unfortunately, mainstream philosophical approaches to the ethics of rationing and prioritisation provide little guidance for these new problems of scarcity. Indeed, the cascading failures were arguably exacerbated by earlier attempts to make health systems leaner and more efficient. This paper argues that health systems should move from simple and atomistic approaches to measuring effectiveness to approaches that are holistic both in focusing on performance at the level of the health system as a whole, and also in incorporating a wider range of ethical concerns in thinking about what makes a health system good. Corporations perform actions that can inflict harm with different levels of intensity, from death to material loss, to both companies’ internal and external stakeholders. Research has analysed corporate harm using the notions of corporate social irresponsibility and corporate crime. Critical management studies have been subjecting management and organizational practices and knowledge to critical analysis, and corporate harm has been one of the main concerns of CMS. However, CMS has rarely been deployed to analyse CSIR and corporate crime. Thus, the aim (...) of this paper is to critically analyse the perspectives of CSIR and corporate crimes on corporate harm via CMS in general and postcolonial studies in particular. The paper contributes by arguing that research on CSIR and corporate crime could be perceived as producing research that does not challenge the essence of contemporary corporation profit-seeking activities that ultimately produces corporate harm. We argue that CSIR and corporate crime are ideologies that assist in disguising the contradiction between producing shareholder value and the social good that is at the heart of the modern corporation system and the current economic system. Furthermore, the postcolonial view of CSIR and corporate crime highlights how they are based on a Western-centric view of corporate harm that ignores the realities and perspectives of the Global South, especially in situations where corporate harm leads to death in the Global South.
